Don't Wait Until It's Too Late

Once a statute of limitations expires, your case is dead. No exceptions. No extensions. Courts will dismiss even the strongest claims filed one day late. If you're unsure about your deadline, get a consultation now — not next month.

Common Statute of Limitations (California)

Deadlines vary by state and claim type. Here are some common California deadlines:

Written Contract
4 years
CCP § 337
Oral Contract
2 years
CCP § 339
Personal Injury
2 years
CCP § 335.1
Fraud
3 years
From discovery
Property Damage
3 years
CCP § 338
Professional Negligence
1-3 years
Varies by profession

These are simplified. Your actual deadline depends on when the claim accrued, tolling factors, and which state's law applies. Check the calculator for a quick estimate, or book a consultation for certainty.

Frequently Asked Questions

What if my deadline is very close?

Contact me immediately. If you're within days of your deadline, I can do an emergency analysis. In some cases, even filing a placeholder complaint can preserve your rights while you gather more information.

Can the statute of limitations be paused?

Sometimes. "Tolling" can pause the clock if: the defendant left the state, you were a minor, the defendant concealed the fraud, or you were incapacitated. I'll analyze whether any tolling exceptions apply to your situation.

What's the discovery rule?

For some claims (especially fraud and professional malpractice), the clock doesn't start until you discovered — or reasonably should have discovered — the harm. This can extend your deadline, but it's fact-intensive and often litigated.

Do you file lawsuits?

I can prepare and file complaints in California. For other states, I'll provide a referral to local counsel if you need to file. Either way, you'll know your deadline and have a clear action plan.

What if I already missed my deadline?

It may not be over. Tolling exceptions, the discovery rule, or multiple claim theories could still apply. I've seen cases that looked time-barred turn out to be viable. Let me analyze the facts before you give up.
